Apple and OpenAI have asked a U.S. judge to dismiss an antitrust lawsuit filed by Elon Musk’s xAI, arguing their partnership does not block competition in the generative AI market.
The complaint, filed in August, claims Apple’s June 2024 deal to integrate ChatGPT into iPhones, iPads, and Macs gives OpenAI an unfair advantage while sidelining Musk’s Grok chatbot and X app. xAI is seeking billions in damages, alleging the agreement amounts to monopolization.
Apple said in its filing Tuesday the deal is “expressly not exclusive” and that it plans to work with other AI chatbot providers. OpenAI’s lawyers separately accused Musk of waging “a campaign of lawfare” against the company, pointing to multiple lawsuits he has filed against OpenAI and its leadership.
xAI “has not alleged any non-speculative harm” from ChatGPT’s integration on Apple devices, OpenAI added. Musk is also suing OpenAI and CEO Sam Altman in California over its shift from nonprofit to for-profit.
