The Lagos High Court in Ikeja has mandated that all 40 members of the Assembly be included as parties in the lawsuit filed by former Speaker Mudashiru Obasa. Justice Yetunde Pinheiro issued this directive during a session on Friday, further adjourning the case to March 7 for the hearing of all pending applications.
Obasa, who was impeached on January 13, 2025, by 36 of his fellow legislators over allegations of gross misconduct and financial misappropriation, is challenging the legality of his removal. He contends that the impeachment proceedings were conducted unlawfully during a recess period and in his absence, as he was reportedly in the United States at the time.
The courtroom witnessed a substantial turnout, with 35 lawmakers loyal to the new Speaker, Mojisola Meranda, present to observe the proceedings. This collective appearance underscores the deep divisions within the Assembly following Obasa’s ousting.
In a related incident on Thursday, Obasa made an unexpected return to the Assembly complex, accompanied by security personnel and supporters, in an attempt to reclaim his position. This move has further intensified the ongoing leadership crisis.
Justice Pinheiro’s decision to include all Assembly members as parties in the lawsuit aims to ensure a comprehensive adjudication of the matter, reflecting the intricate nature of the dispute. As the March 7 hearing approaches, stakeholders and observers keenly await the court’s determination on the pending applications, which could have far-reaching implications for the governance and political stability of Lagos State.
The outcome of this legal battle is poised to set a precedent regarding the procedural conduct of legislative bodies in Nigeria, particularly concerning the removal of high-ranking officials during recess periods and in their absence.
